Hurricane Sandy caused extensive damage and devastation to thousands of New York City homes, mostly as a result of flooding. And if they weren’t aware already, homeowners quickly learned that flood damage is not covered by homeowner’s insurance. Yet, even for those homeowners who had flood insurance, many are still struggling to be fully compensated to cover their losses.

The Center’s legal services partners can help, free of charge. Legal services providers in the Center’s Network can advise homeowners on how to address underpayments by their flood insurance carrier by documenting the damage caused by the storm. It is important that homeowners seek this help before October 28th, 2014, which is the deadline for completing what is called a “Proof of Loss” claim. A Proof of Loss claim is a dispute filed after a flood insurance carrier does not pay out a sufficient amount following an initial claim, and it’s the only way that homeowners can seek further payment from their flood insurers and preserve the ability to sue the insurer, if necessary.

In April of this year, the Center organized a series of clinics focused on helping homeowners with Proof of Loss claims in conjunction with Legal Services NYC, New York Legal Assistance Group (NYLAG), Touro Law Center, Brooklyn Jubilee, and Make the Road New York Although no more clinics are currently scheduled, attorneys are still available to assist homeowners on a case-by-case basis.
